OFFICIAL COUNCIL PROCEEDINGS
AUGUST 15, 2005

A regular meeting of the City Council of the City of Harbor Beach was held on Monday,
August 15, 2005 at City Hall. The meeting was called to order at 2:30 p.m. by Mayor Swartz.

Present: Kleinknecht, Schelke, Semp, Wood and Mayor Swartz
Finance Officer Youatt and Engineer Bergdolt
Police Chief Schock, DPW Foreman Shedd, Recreation Director Wruble and
WWTP Superintendent Cregeur

Absent: Water Plant Superintendent Miller (with notice)

It was moved by Semp, seconded by Schelke to approve the minutes of the August 1, 2005 Council meeting as presented. Motion carried. 5 yeas.

It was moved by Kleinknecht, seconded by Wood to approve the minutes of the August 3, 2005
Police Committee meeting as presented. Motion carried. 5 yeas.

It was moved by Schelke, seconded by Semp to approve the August 2, 2005 Recreation Commission minutes as corrected, with corrections including attendance of Mayor Swartz, review of staff payroll and review of staff for the Beach Assault Basketball Tournament. Motion carried.

Citizen Comment: John Fitzgibbon stated letters sent to his tenants by the City Attorney were sent to 5419 North Huron instead of the correct address of 419 North Huron Avenue. He also stated his tenants have agreed to an inspection date of August 26, 2005 at 1:30 p.m. for the interior building inspection under the City’s Dangerous Building Ordinance.

Department Head Reports: Police Chief Schock reported that the residents at the Harbor Beach Resort were very pleased with the response to the fire at the Dining Room/Kitchen facility. An amendment to the parking ordinance to restrict parking of commercial trailers and vehicles on the street is in progress. Monthly statistics will be published in the “Harbor Beach Times,” as discussed by the Police Committee. Both the Maritime Festival and the Our Lady of Lake Huron Festival went well with few problems. Two breaking and entering cases have been solved recently. The police vehicles have been running well with the Chevy scheduled for replacement
in 2006. Looking to hire another part-time police officer.

DPW Foreman Shedd reported that the brick downtown was sealed and banners were installed on the street lights. About 800 feet of new water main was installed by the crew to service the new
Lighthouse Assembly of God church on Section Line Road. School crosswalks on the street have been painted. The dredge disposal site has been pumped out about 20 times due to wet weather. Work continues on compliance with DEQ at this site. The sidewalk replacement program this summer was recently completed. The Port Hope-Gore-Rubicon utility meter was vandalized.
All equipment has been running well.

Department Head Reports (continued): Recreation Director Wruble reported that the Playscape construction project was a success. About 78 youth participated in the summer basketball camp. 81 teams and about 320 participants played in the annual Beach Assault Basketball tournament. The annual seasonal boater and camper picnic and the annual volunteer picnic will be held this Saturday, August 20th. There have been 43 seasonal boaters and about
80 seasonal campers this year. Only one significant incident at North Park so far this year.
Repairs have been made at the marina this year including sidewalk repair and tile work in the restroom building. The temporary storage of recreation vehicles and boats/jet skiis along M25 has been discontinued.

Wastewater Treatment Plant Superintendent Cregeur reported that there was only one minor overflow at the pump station so far this year. There has been recent high loading and low oxygen
at the plant. Sensient was required to temporarily suspend sending their waste due to high loading. Two pumps at the pump station will be rebuilt.

OLD BUSINESS: Finance Officer Youatt provided Council with an update regarding the dangerous buildings. Letters have been sent by Attorney Ferris to property owners requesting inside building inspections.

It was moved by Semp, seconded by Schelke to bill all property owners the appropriate water and sewer connection fees ($ 60 total prior to October 7, 2002 and $ 1,500 total after October 7, 2002) who have not been billed. Motion carried. 5 yeas.

NEW BUSINESS: It was moved by Schelke, seconded by Wood to approve the fuel and labor surcharge for residential trash pickup as requested by Richfield Management and in accordance with our contract, with an increase of forty-six cents per month per household, from $ 9.56 per month to $ 10.02 per month, effective immediately. Motion carried. 5 yeas.

Council reviewed bids received for rebuilding two pumps at the WWTP pump station at Bathing Beach Park. Bids received were from Detroit Pump and Manufacturing Company for $ 3,150 and from HydroDynamics Inc. for $ 4,250. It was moved by Wood, seconded by Kleinknecht to approve the bid from Detroit Pump as presented. Motion carried. 5 yeas.

It was moved by Schelke, seconded by Semp to approve an increase in mileage reimbursement for City business travel from twenty-five cents per mile to thirty-five cents per mile effective immediately. Motion carried. 5 yeas.

A one-year renewal of the City’s computer maintenance service agreement with MicroTech Services, Holt, Michigan, at a cost of $ 1,173 for 15 hours of service, with carry over of 7 unused hours, was presented to Council. It was moved by Semp, seconded by Wood to approve the contract renewal as presented and to authorize Finance Officer Youatt to execute same on behalf of the City.. Motion carried. 5 yeas.

NEW BUSINESS (continued): A proposal from Wolverine Fireworks, Kawkawlin, Michigan, for a three-year renewal of the Maritime Fireworks contract for years 2006-08 was presented to Council. The contract calls for a cost of $ 3,776.00 each year. It was moved by Semp, seconded by Kleinknecht to approve the contract as presented and to authorize Finance Officer Youatt to execute same on behalf of the City. Motion carried. 5 yeas.

Engineer Report: A pre-construction meeting for the sanitary sewer rehabilitation project is scheduled for August 31st. Insituform will provide a progress schedule for the project at this meeting. The survey department has completed property descriptions for surveys for easements for the Lighthouse Assembly of God property and the Gempel property as requested.

Finance Officer Report: A conference call was held on August 12th regarding the application for ownership of the Lighthouse. The Lighthouse Preservation Society is assisting with the final draft of the application. A reminder of the annual Michigan Municipal League convention September 20th through September 23rd. The annual summer City picnic is set for August 28th.
A meeting will be held in September with Tom Traciak and Dave Bergdolt regarding financing issues for the Sanitary Sewer Retention Basin project.

Council Reports: The Art Fair was a success this past weekend. The fire department did an excellent job on the fire at the Harbor Beach Resort dining/kitchen facility. The annual meeting of the Lighthouse Preservation Society is set for August 18th.

There being no further business, the meeting was adjourned at 3:37 p.m.
