Meeting Minutes for October 1, 2007

OFFICIAL COUNCIL PROCEEDINGS
OCTOBER 1, 2007

A regular meeting of the City Council of the City of Harbor Beach was held on Monday, October 1, 2007 at City Hall. The meeting was called to order at 7:00 p.m. by Mayor Swartz.

Present: Burkhard, Goniewicha, Kleinknecht, Wood and Mayor Swartz
Finance Officer Youatt

Absent: None

It was moved by Burkhard, seconded by Kleinknecht to approve the agenda as presented. Motion carried. 5 yeas.

It was moved by Goniewicha, seconded by Wood to approve minutes of the September 17, 2007 Council meeting as presented. Motion carried. 5 yeas.

It was moved by Burkhard, seconded by Goniewicha to approve minutes of the September 26, 2007 Police Committee meeting as presented. Motion carried. 5 yeas.

Bills for September 2007 in the amount of $ 281,001.60 were presented to Council. It was moved by Kleinknecht, seconded by Burkhard to approve payment of the bills as presented. Motion carried. 5 yeas.

A bill from Wade-Trim for Sewer Retention Basin (SRF) construction engineering in the amount of $ 68,147.48 was presented to Council. It was moved by Wood, seconded by Burkhard to approve payment of the bill as presented. Motion carried. 5 yeas.

Citizen Comment: Cindy Goniewicha inquired if Council was going out to bid for the trash contract. Youatt stated it was up to Council if they wanted to bid it out. Youatt also stated the current contract with Richfield expired either last August or will expire this August. Youatt will report on the contract expiration date at the next Council meeting.

Jack Kriete inquired about the status of employment contracts. Mayor Swartz stated Council is working on the health insurance issue and negotiations will continue as this issue is being resolved.

OLD BUSINESS: Mayor Swartz reported on the pigeon keeping issue brought up by City resident Deanna Holdwick, Lytle Avenue, at the previous meeting. The City consulted with City Attorney John Ferris and based on his interpretation of the definition of poultry, the City will allow the keeping of pigeons as long as they do not become a nuisance.

NEW BUSINESS: Youatt presented a list of uncollectible and outstanding utility bills dating back to 1994. Following discussion, it was moved by Wood, seconded by Burkhard to write off all utility bills presented totaling $ 11,416.09. The following bills will be collected:

Engineer Report: Youatt reviewed the engineer report by Wade-Trim dated October 1, 2007 and noted the next construction progress meeting is set for Tuesday, October 23, 2007 at 4:00.

Finance Officer Report: The State Legislature approved a continuation budget earlier this morning with an increase in the state income tax and also adding tax on certain services. Revenue sharing remains in place without cuts. The new Dodge police car was damaged and the cause is being investigated.

Council Reports: Councilmember Wood stated it was an honor to carry the City flag at the opening ceremony at the annual MML conference in Traverse City. Mayor Pro-Tem Kleinknecht reported that the MML conference had some very good programs and that he learned the need to plan was important for our community. Councilmember Goniewicha reported on meetings he attended at the MML conference including one on the North Coast project which will result in marketing and purchasing efforts of states belonging to the Great Lakes region. Mayor Swartz reported that Councilmembers and Finance Officer Youatt attended a variety of sessions in order to gain as much information as possible at the MML conference. Also reported that a committee is working with Zoning Administrator Lermont on a proposed International Property Maintenance Code which would regulate blight and grass/weeds in the City.

There being no further business, the meeting was adjourned at 8:00 p.m.
