OCTOBER 17, 2005
A regular meeting of the City Council of the City of Harbor Beach was
held on Monday,
October 17, 2005 at City Hall. The meeting was called to order at 2:30
p.m. by Mayor Swartz.
Present: Kleinknecht, Schelke, Semp, Wood and Mayor Swartz
Finance Officer Youatt and Engineer Bergdolt
Also Present: WWTP Superintendent Cregeur
It was moved by Schelke, seconded by Semp to approve the minutes of the
October 3, 2005
Council meeting as presented. Motion carried. 5 yeas.
Citizen Comments: Jack Kriete, Whitcomb Street, inquired about the maintenance
of the road at Stoneybrook Subdivision that was discussed at the last
Council meeting. Mayor Swartz reported that Mr.Diehl had informed the
Mayor that he would be taking on maintenance of the street over the winter
and will look to pave the road next summer.
E.J. Vergolini, North First Street, stated his garbage had not been picked
up. Youatt will inform
Richfield to pick up the garbage at Mr. Vergolini’s residence.
John Fitzgibbon, Barlett Street, said he would like to state for the
record that he had arranged for an inspection of his house at 419 North
Huron Avenue at the August 15, 2005 Council meeting with the inspection
to take place on August 26, 2005. Also that the building inspector, Mr.
Peruski, was never informed if the August 26th inspection date.
Department Head Reports: WWTP Superintendent Cregeur reported that there
was an upset at the plant on August 12th which Art had determined was
caused by Sensient Flavors. A meeting was held with Jim Tenbusch and other
Sensient staff on September 29th regarding the event.
Sensient had exceeded their limitations on BOD and Suspended Solids and
a fine in the amount of
$ 1,000 per day ($ 4,000 total) was imposed by Art on Sensient, in accordance
with the Industrial User Permit and Sewer Use Ordinance. Also reported
that a pump failed at the pump station due to electronic failure. The
pump has been rebuilt. About 400,000 gallons of sludge is being land applied
this fall.
OLD BUSINESS: It was moved by Semp, seconded by Schelke to approve the
Credit Card Policy for the City of Harbor Beach as presented. Motion carried.

NEW BUSINESS: Council reviewed the recommendation of the Planning Commission
to approve a Conditional Use Permit for Diane Manenti, owner of Ernesto’s
Pizza located at
129 State Street, to allow construction and use of a residential unit
above her building in accordance with the Site Plan the Planning Commission
has approved. It was moved by Kleinknecht, seconded by Wood to approve
the Conditional Use Permit application as submitted.
Motion carried. 5 yeas.

NEW BUSINESS (continued): Council reviewed a computer software maintenance
proposal from Fund Balance, the program the City uses for financial reporting.
Cost for the maintenance plan is $ 4,152.00, the same as the current maintenance
plan. The plan runs from November 30, 2005 to November 29, 2006. It was
moved by Schelke, seconded by Semp to approve the computer software maintenance
plan with Fund Balance as presented. Motion carried. 5 yeas.
Engineer Report: The sanitary sewer rehabilitation project began October
12th with mobilization of equipment by Insituform. Following cleaning
of the sewer mains, the relining work will begin
in the alley sections between Nelson, Ferris and Whitcomb Streets, with
Bartlett, M25 and Wood Streets to follow.
Finance Officer Report: A building inspection was conducted on 419 North
Huron Avenue on
October 11th. The final inspection at 403 Lytle Avenue will be scheduled
soon. We have received the approved Coast Guard license for the Lighthouse
from the Coast Guard. The DEQ has given approval of the work at the dredge
disposal site. An Administration Committee meeting will be scheduled to
review the Zoning Administrator position.
