OFFICIAL COUNCIL PROCEEDINGS
SEPTEMBER 20, 2004
A regular meeting of the City Council of the City of Harbor Beach was
held on Monday, September 20, 2004 at City Hall. The meeting was called
to order at 1:30 p.m. by Mayor Pro-Tem Schelke.
Present: Ahrens, Goniewicha, Semp and Mayor Pro-Tem Schelke
Finance Officer Youatt
Absent: Mayor Ramsey and Engineer Bergdolt (both with notice)
Corrections/Additions to Agenda: A proposed first amendment
to the City’s Administrative Consent Order (ACO) with the DEQ
was placed on the agenda under New Business.
It was moved by Semp, seconded by Ahrens to approve the
minutes of the September 6, 2004 Council meeting as presented. Motion
carried. 4 yeas.
A bill from MDOT for the M25 construction project in the
amount of $20,187.00 and a bill from Wade-Trim for the Streetscape Electrical
Energy for $472.50 were presented to Council. It was moved by Goniewicha,
seconded by Ahrens to approve payment of the bills as presented. Motion
carried. 4 yeas.
Citizen Comment: Comment regarding offensive odor from
industry. Youatt will set up a meeting with the Community Advisory Panel.
OLD BUSINESS: None
NEW BUSINESS: It was moved by Ahrens, seconded by Goniewicha to establish
Trick or Treat on Halloween night, Sunday, October 31, 2004 from 5:00
p.m. to 6:30 p.m., with the start and finish to be signaled by a blast
from the fire whistle. Motion carried. 4 yeas.
It was moved by Semp, seconded by Ahrens to switch the
starting times for the City Council meetings for the October 4, 2004
meeting to 1:30 p.m. and the October 18 meeting to 7:00 p.m. Motion
carried. 4 yeas.
Council discussed a letter received from the DEQ Enforcement
Unit regarding a proposed First Amended Administrative Consent Order,
Dated September 16, 2004. The amendment is in regarding to a new schedule
for City compliance for submitting preliminary and final plans for DEQ
review and approval. The current date for final plans is September 30,
2004. The new dates are March 31, 2005 for preliminary plans and May
31, 2005 for final plans. Youatt recommended that the City also request
an eight month extension on construction completion, from December 31,
2006 to August 31, 2007. It was moved by Semp, seconded by Ahrens to
authorize the Finance Officer to send a letter in reply to the DEQ Enforcement
Unit as recommended by Finance Officer Youatt. Motion carried. 4 yeas.

Engineer Report: None
Finance Officer Report: The M25 project continues on schedule
with paving on M25 to start tomorrow. A meeting was held last week with
Dow AgroScience officials regarding their request for increased permit
levels for suspended solids. Sensient Technologies exceeded permit levels
for phosphorus, biological oxygen demand and suspended solids on September
7, 8 and 9 and will be fined accordingly.
Council Reports: The chili contest downtown this past
weekend was well attended.
There being no further business, the meeting was adjourned
at 2:00 p.m.
