OFFICIAL COUNCIL PROCEEDINGS
SEPTEMBER 19, 2005
A regular meeting of the City Council of the City of Harbor Beach was
held on Monday,
September 19, 2005 at City Hall. The meeting was called to order at 2:30
p.m. by Mayor Swartz.
Present: Kleinknecht, Schelke, Semp, Wood and Mayor Swartz
Finance Officer Youatt and Engineer Bergdolt
Absent: None
Corrections/Additions to Agenda: Review of a Coast Guard License for
the use of the Harbor Beach Lighthouse was added to the agenda under Old
Business.
It was moved by Semp, seconded by Schelke to approve the minutes of the
September 6, 2005 Council meeting as corrected, with a change in date
under Citizen Comment from August 17, 2005 to August 26, 2005. Motion
carried. 5 yeas.
Citizen Comment: None
OLD BUSINESS: The second reading of a proposed Commercial Vehicle Parking
Ordinance was presented to Council. Youatt explained the problems with
this proposed ordinance, including questions regarding pickup trucks being
included in the definition of commercial vehicles. Youatt stated that
he and Chief Schock further reviewed the proposed ordinance and have recommended
some minor changes for Council consideration. Following further discussion,
it was moved by Schelke, seconded by Kleinknecht to reject the proposed
Commercial Vehicle Parking Ordinance on second reading as presented. Motion
carried. 5 yeas.
The first reading of a revised Commercial Vehicle Parking Ordinance was
presented to Council. This ordinance specifically excludes pickup trucks
in the definition of commercial vehicles and also adds a provision that
commercial vehicles shall not park in such a manner causing a traffic
hazzard. It was moved by Semp, seconded by Kleinknecht to approve the
revised Commercial Vehicle Parking Ordinance as presented. Motion carried.

Youatt provided Council with an update on the dangerous buildings. An
interior inspection date needs to be scheduled for 419 North Huron Avenue
and for 403 Lytle Avenue. The owners and tenants will be notified of the
proposed inspection dates.
Youatt presented a License for use of the U.S. Coast Guard Harbor Beach
Lighthouse to Council. The license is for one year and will allow the
City and the Lighthouse Preservation Society the opportunity to continue
maintenance and preservation efforts until the transfer of ownership can
be effected. Youatt stated that City Attorney John Ferris reviewed the
proposed license and did not see anything in it that should be a problem
for the City. It was moved by Wood, seconded by Semp to approve the License
with the Coast Guard for use of the Harbor Beach Lighthouse as presented
and also to authorize the Finance Officer to execute same on behalf of
the City. Motion carried. 5 yeas.

NEW BUSINESS: Youatt presented to Council a proposal for design engineering
services from
Wade-Trim to prepare engineering plans and specifications for the proposed
modifications to the water retention ponds at the Water Treatment Plant.
Cost for design engineering for this project is $ 11,700. It was moved
by Schelke, seconded by Semp to approve the proposal as submitted.
Motion carried. 5 yeas.
Youatt presented a proposal from Liquid Engineering to remove sediment
and inspect the condition of the water tower and also to remove a cast
iron elbow from the reservoir at the Water Treatment Plant. Youatt stated
that removal of the cast iron elbow will increase useable water volume
by 4 feet and decrease water production time by as much as 2 hours per
day. Cost is $ 2,890.00 for the water tower work plus $ 575 for the first
hour and $ 425 for each additional hour for removal of the cast iron elbow.
It was moved by Semp, seconded by Schelke to approve the proposal as submitted.
Motion carried. 5 yeas.
Engineer Report: The sanitary sewer rehabilitation project will begin
in mid-October with mobilization of equipment and cleaning of the sewer
mains. The project will be completed in approximately 4 to 6 weeks. The
Water Treatment Plant pond modification project will be ready for bids
in early 2006.
Finance Officer Report: Work continues on the dredge disposal site with
completion anticipated by end of next week. The power cable to the lighthouse
has been restored. The annual MML conference starts tomorrow.
Council Reports: The annual downtown chili cookoff was well attended
this last weekend.
425 ballots were taken and Schmalz Plumbing and Heating took first place
this year. The hurricane relief effort went well this past week as the
semi trailer was packed with food and clothing for the Gulf Coast victims.
The trailer was delivered to the Salvation Army in Saginaw for distribution.
There being no further business, the meeting was adjourned at 3:35 p.m.
